1. Identification of Ticktur and Acceptance of the Contract
The platform for the sale and management of tickets, activities, and digital products (hereinafter the “Platform”) is operated by TICKTUR GLOBAL LTD, located at Efesou 9, 5280 Paralimni, Famagusta, Cyprus, VAT number: 60195604W.
By accessing, browsing, or booking through the Platform, the user fully accepts these Policies and Conditions (hereinafter the “Contract”). This contract is binding and governed by the laws of the Republic of Cyprus, which constitute Ticktur’s main legal framework.
The user declares to have read, understood, and accepted these conditions, undertaking to use them in accordance with the law, good faith, and e-commerce standards.
2. Definitions and Operational Scope
For the correct interpretation of this Contract, the following definitions are established:
• User: natural or legal person accessing the Platform and purchasing tickets, services, or digital products.
• Organizer/Supplier: entity responsible for providing an attraction, event, or activity offered on the Platform.
• Attraction/Service: tourist, cultural, or leisure activity, such as museums, concerts, shows, tours, or experiences.
• Audioguide: personal and non-transferable digital product of Ticktur, accessible via unlock code or credentials.
• Marketplace: digital showcase where attractions managed by external Organizers and attractions directly managed by Ticktur are published.
• Ticktur CRM: management system through which Ticktur provides technical and operational support to Organizers, although the final responsibility for the attraction always lies with the Organizer.
• Direct distribution: mode in which Ticktur acts as the official seller and is fully responsible to the User.
3. Service Modes and Responsibilities
Ticktur offers its services under three main modes, each with distinct responsibilities:
Direct distribution: Ticktur sells as the official provider, guaranteeing ticket validity and handling cancellations, refunds, and incidents for the User.
Marketplace:
a) Self-managed by external Organizers: Ticktur acts as a technological intermediary. The Organizer is responsible for published information, access, and the experience. Ticktur does not assume this responsibility but will mediate in case of issues.
b) Managed directly by Ticktur: although listed in the Marketplace, Ticktur assumes the same responsibilities as in direct distribution.
Ticktur CRM: Organizers using the CRM benefit from operational and technical support by Ticktur (ticket issuance, access management, basic support). The Organizer remains the final responsible party for the attraction.
4. Informational Transparency and Pre-Contract Obligations
Ticktur guarantees the User access to clear and complete information before confirming a purchase, including:
• Essential features of the attraction.
• Total price including taxes and management fees.
• Applicable cancellation policy.
• Inclusion of additional products, such as the Audioguide.
• Age restrictions, safety rules, or accessibility.
Each Marketplace listing clearly indicates who is responsible: the Organizer or Ticktur. This is crucial for the User to know the contractual responsibility.
5. User Registration and Obligations
Some features require creating a personal account on the Platform.
The User agrees to provide truthful, complete, and up-to-date data and to safeguard their credentials.
Ticktur may suspend or cancel an account in case of fraud, breach, or misuse.
The User may request account deletion if no pending obligations exist. Ticktur will retain certain data for periods required by Cypriot and EU fiscal and data protection regulations.
6. Booking Process
The purchase process follows five steps:
1. Select the attraction or digital product.
2. Enter the required information.
3. Review a summary with final price and applicable conditions.
4. Confirm purchase and payment.
5. Receive electronic confirmation along with digital tickets or access codes.
Tickets are delivered digitally, usually via QR code or barcode.
The contract is considered finalized when Ticktur confirms the purchase electronically.
7. Pricing, Taxes, and Invoicing
Displayed prices include taxes, mandatory fees, management costs, and, if applicable, additional services such as the Audioguide.
These prices may differ from the official attraction rates due to complementary services, intermediary costs, or commercial agreements.
Final price may include payment gateway commissions (Stripe, PayPal, or others), indicated before confirmation.
The User’s bank may apply currency exchange or international transaction fees not related to Ticktur.
If a manifest pricing error is detected, the purchase may be canceled and refunded.
Invoices will be issued by Ticktur or the Organizer depending on the mode and reflect the total paid amount.
8. Audioguide: Digital Nature and Cancellation
The Audioguide is a personal, non-transferable digital product, delivered via unlock code or credentials.
It is considered delivered once the code is sent.
Once delivered, cancellation or refund is not permitted, even if the User does not use the product.
Ticktur maintains electronic records of delivery and activation as proof.
The User receives a personal, limited, non-exclusive license. Reproduction, distribution, resale, or unauthorized use is prohibited.
9. Tickets: Terms of Use
Tickets issued by the Platform are digital, delivered via QR code or barcode.
Unless expressly stated, they are personal and non-transferable, and identification may be required.
Use is subject to the Organizer’s internal rules (schedule, age, safety, health, dress code).
No-shows or lateness may result in lost access without refund.
Unauthorized resale, duplication, or code manipulation is prohibited.
Ticktur may limit ticket numbers per transaction or period to prevent abuse.
10. Cancellations, Changes, and Refunds
Self-managed Marketplace: Organizer policies apply (Ticktur mediates).
Ticktur-managed Marketplace and Direct Distribution: Ticktur policies apply, communicated before purchase.
Ticktur CRM: Organizer’s cancellation policy applies.
Audioguides: non-cancellable and non-refundable once the code is delivered.
Approved refunds are processed using the same payment method within reasonable timeframes.
11. Rescheduling, Modifications, and Force Majeure
Attractions may be affected by Organizer changes or force majeure.
Force majeure: unforeseeable or unavoidable circumstances (extreme weather, strikes, disasters, government restrictions, health emergencies, major service interruptions).
Organizer may reschedule, provide equivalent alternatives, or refund according to applicable policy.
Ticktur assumes the same obligations when acting as direct seller.
These circumstances limit liability, excluding unforeseen additional damages.
12. Fraud Prevention, Payment Security, and Chargebacks
Fraud prevention systems analyzing purchase patterns are applied.
Enhanced authentication or additional validation may be required.
Suspicious operations (mass resale, ticket duplication, stolen cards) may be canceled, and associated accounts suspended.
Unjustified chargebacks allow Ticktur to claim reversed amounts, administrative costs, and fees. Legal action may be taken in severe cases.
13. Customer Service and Ticktur’s Mediating Role
Ticktur provides official channels for inquiries, issues, and complaints.
Self-managed Marketplace and CRM: Ticktur diligently mediates between User and Organizer.
Direct Distribution and Ticktur-managed Marketplace: Ticktur assumes responsibility towards the User.
14. Marketplace Transparency and Listing Labels
Each listing indicates if the attraction is managed by an external Organizer or Ticktur.
This determines responsibility, cancellation policy, and invoice issuer.
Ticktur periodically reviews published information to meet transparency standards.
15. Booking Modifications: Names, Dates, and Extras
The User may request changes (holders, dates, schedules, extras) subject to attraction policy.
Self-managed Marketplace: Organizer decides acceptance and conditions.
Direct Distribution and Ticktur-managed attractions: Ticktur policies apply, which may allow free or paid changes.
Extras may have specific non-modifiable or non-refundable conditions.
16. Accessibility, Age Restrictions, and Special Needs
Each attraction may include restrictions (minimum age, physical requirements, accessibility).
The User must review these conditions before booking.
Special needs should be communicated in advance; Ticktur forwards requests to the Organizer.
Acceptance is not guaranteed but will be handled diligently.
17. Prohibited Conduct and Platform Protection Measures
Prohibited conduct includes:
• Fraudulent or illegal use.
• Providing false data or identity impersonation.
• Purchases via bots, scripts, or automation.
• Unauthorized resale or duplication of tickets and Audioguides.
• Code manipulation or forgery.
• Mass scraping or reverse engineering.
• Posting defamatory, false, or discriminatory content.
Ticktur may suspend accounts, cancel purchases, and take legal action.
18. Intellectual Property of the Platform and Audioguide
Designs, software, logos, databases, and graphic materials belong to Ticktur or third-party licensors.
The Audioguide is copyrighted and granted under a personal, limited, non-exclusive license.
Reproduction, distribution, public communication, or transformation without express authorization is prohibited.
Ticktur may take legal action against infringements.
19. Limitation of Liability of Ticktur
Direct distribution and Ticktur-managed Marketplace: User liability is limited to the amount paid for the affected service.
Self-managed Marketplace and CRM: Organizer liability; Ticktur acts as mediator.
No responsibility for indirect damages, lost profits, data loss, or expectations.
Uninterrupted operation is not guaranteed, although reasonable availability standards are applied.
20. Personal Data and Privacy
Processing in accordance with the Privacy Policy published on the Platform.
Collected data: contact info, payment data handled by secure gateways, access logs, purchase and Audioguide data.
Purposes: complete purchases, manage accounts, prevent fraud, fulfill legal and tax obligations, customer support, commercial communications with consent.
Marketplace and CRM share necessary data with responsible Organizers.
Rights: access, rectification, deletion, restriction, objection, portability under Cypriot and EU law.
21. Use of Cookies and Similar Technologies
Necessary, functional, analytical, and marketing cookies are used.
The User can accept, reject, or customize cookies in the initial notice and modify preferences later.
Transfers outside the EEA are covered by standard contractual clauses or other adequate safeguards ensuring equivalent protection.
22. Languages, Versions, and Precedence of Conditions
The Platform and these Policies may be offered in multiple languages.
In case of discrepancy, the official English version prevails as the reference in Cyprus.
Translations (including Spanish) are for informational purposes.
Cypriot law and courts prevail without affecting mandatory consumer rights.
23. Links to Third-Party Sites and Services
Links to third-party sites, apps, or services may be provided as a convenience.
They do not imply endorsement or control by Ticktur.
Ticktur is not responsible for availability, security, accuracy, or legality of these services.
Users access at their own risk, reviewing external conditions and privacy policies.
24. Assignment, Subcontracting, and Continuity of Service
Ticktur may subcontract technical, logistical, or support services ensuring compliance with regulations.
It may assign contractual positions to group companies or third parties in corporate operations without affecting acquired rights.
The service may experience scheduled interruptions for maintenance or updates; users will be informed when possible.
25. Complaints, Alternative Dispute Resolution, and ODR
Ticktur provides official channels for inquiries and complaints.
Users may use ADR mechanisms in their country if not satisfied.
The European Commission ODR platform (https://ec.europa.eu/consumers/odr) enables online dispute resolution.
Use of ADR or ODR does not prevent recourse to competent courts in Cyprus.
26. Force Majeure
Neither Ticktur nor Organizers are liable for breaches or delays due to force majeure.
Examples: strikes, lockouts, riots, armed conflicts, natural disasters, fires, floods, pandemics, unforeseen administrative decisions, major telecom failures.
Obligations are suspended while the cause persists without compensation beyond prescribed refunds.
27. Applicable Law and Jurisdiction
The Contract is governed exclusively by the laws of the Republic of Cyprus.
Disputes are subject to the competent courts of Cyprus.
EU consumers retain mandatory rights under national law.
28. Policy Changes and Official Communications
Ticktur may modify these Policies to adapt to legal changes, service evolution, or technical improvements.
New versions apply from publication and only affect subsequent purchases.
Relevant changes will be communicated via visible notices or direct communications.
Official communications must be made through identified channels; Ticktur is not responsible for messages in unofficial or fraudulent channels.
